Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and SocialShot AI, a brand owned and operated by All World Enterprises, a sole proprietorship registered in India ("we", "us", "our"), governing access to and use of the SocialShot AI platform, website, APIs, and related services (collectively, the "Service").

The Service includes every feature, tool, generation type, and content format we offer now or introduce in the future — for example image, video, and text generation — together with our website, dashboard, marketing pages, blog, comparison and informational pages, documentation, and APIs. These Terms apply to every part of the Service you access, however it evolves, unless we publish separate terms for a specific feature.

By creating an account, accessing the dashboard, or using any paid or free feature, you agree to these Terms, our Privacy Policy, AI Services Addendum, and Acceptable Use Policy, each incorporated by reference.

You must be at least 18 years of age and capable of entering a binding contract under the Indian Contract Act, 1872. If you use the Service on behalf of a business, you represent that you have authority to bind that entity.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at legal@socialshot.ai if you suspect unauthorised access.

We may suspend or terminate accounts that violate these Terms, applicable law, or pose security or abuse risk.

Paid features consume prepaid credits or subscription entitlements as described on our Pricing page. Prices are shown exclusive of applicable GST unless stated otherwise.

Except where required by our Refund & Cancellation Policy or applicable consumer law, fees are non-refundable once credits are consumed or a billing period has started.

You retain ownership of product images, brand assets, prompts, model references, and other materials you upload ("Customer Content"). You grant us a limited, worldwide, non-exclusive licence to host, process, transmit, and display Customer Content solely to provide and improve the Service, including running AI models on your instructions.

You represent and warrant that, for every image, product, garment, brand, logo, prompt, description, and — critically — every human model, face, or likeness you upload, provide, describe, or select for use in the Service, you own or have obtained all rights, licences, model releases, consents, and permissions necessary to use it and to have AI-generated content created from it. You are solely responsible for confirming you have full authority to use any model or likeness before using it in the Service.

You must not upload or use any person's photograph, face, or likeness without that person's explicit consent, and you must not use the Service to depict a real, identifiable person you are not authorised to depict.

"Output" means any content the Service generates for you in any current or future feature — including images, video, audio, text, captions, and any other media.

Subject to your compliance with these Terms and payment of applicable fees, we assign to you our rights, if any, in Output produced specifically for your account from your Customer Content, to the extent permitted by law and third-party model terms.

You are solely and fully responsible for everything generated from the data, images, models, prompts, and instructions you provide, and for how you use, publish, distribute, or commercialise those outputs. We do not pre-screen or approve outputs and make no representation that any output is lawful, accurate, non-infringing, or suitable for your intended use.

AI outputs may be similar to outputs generated for other users and may contain errors or unexpected elements. You must independently review each output and ensure it complies with all applicable laws, advertising standards, platform policies, and third-party rights before any use.

By uploading Customer Content, selecting a model, or generating any output, you represent and warrant on a continuing basis that: (a) you have the full legal right and authority to use every model, person, likeness, product, garment, brand, logo, and other material you provide or select; (b) you have obtained any model release, licence, or consent required to depict any real person; (c) your Customer Content and your use of the resulting outputs comply with all applicable laws and do not and will not infringe, misappropriate, or violate any third party's intellectual-property, privacy, publicity, moral, contractual, or other rights; and (d) you will use the Service only in accordance with these Terms and our Acceptable Use Policy.

These representations are a material condition of your right to use the Service. Any content, model, or likeness you cannot fully authorise must not be used.

The Service is intended solely for lawful, commercial fashion, product, and marketing content. You may not use, attempt to use, or instruct the Service to generate, and the Service is designed not to knowingly produce, any nude, partially nude, topless, lingerie, bikini, or swimwear content presented in a sexualised manner, nor any sexually suggestive, pornographic, fetish, or otherwise adult or explicit content — whether image, video, audio, or text, and in any current or future generation feature.

You must never generate or attempt to generate sexual content of any kind involving a minor, or any depiction of a minor in a suggestive, revealing, or inappropriate context. Such conduct is strictly prohibited and will be reported to the appropriate authorities where required by law.

We apply automated and manual safety filters intended to refuse prohibited requests, and we may block, remove, refuse, or refund at our sole discretion any content, prompt, or Output. Repeated or serious attempts to generate prohibited content may result in immediate suspension or termination without refund.

You may not use the Service to generate unlawful, deceptive, or harmful content; infringe intellectual property; impersonate any person or brand without authorisation; create non-consensual or misleading depictions of real people; scrape or reverse engineer the platform; circumvent credit, safety, or rate limits; or resell access without written consent. You agree to defend, indemnify, and hold harmless SocialShot AI, its proprietor, personnel, contractors, and service providers from and against any and all claims, demands, proceedings, liabilities, damages, losses, fines, penalties, and costs (including reasonable legal fees) arising out of or relating to: (a) your Customer Content; (b) any model, person, likeness, product, brand, logo, or material you provided or selected; (c) your use, publication, or distribution of any AI output; (d) your breach of these Terms, the Acceptable Use Policy, or any applicable law; or (e) your infringement or misappropriation of any third party's intellectual-property, privacy, publicity, or other rights.

This indemnification obligation survives termination or expiry of your account and these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

While we apply content-safety filters, we do not warrant that they will block every prohibited request or that every output will be free of unexpected content. You remain solely responsible for reviewing all outputs and for ensuring you hold the rights to every model and material you use.

To the maximum extent permitted under Indian law, our aggregate liability arising from or relating to the Service shall not exceed the greater of (a) amounts you paid us in the three months preceding the claim, or (b) INR 10,000.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, including any liability arising from Customer Content, models or likenesses you supplied, or your use of AI outputs.

All third-party product names, brand names, and trademarks referenced anywhere in the Service — including on comparison, marketplace-readiness, or informational pages — remain the property of their respective owners and are used only for identification, descriptive, or fair comparative purposes. Their use does not imply any affiliation with, endorsement by, sponsorship from, or partnership with those owners.

Any comparison, benchmark, or compatibility statement we publish reflects our good-faith assessment at the time of writing and may change without notice. Marketplace-readiness features (for example, outputs formatted for a particular retailer) do not guarantee acceptance by, or compliance with the current policies of, any third-party platform; you remain responsible for meeting each platform's requirements.

We may update these Terms and any incorporated policy from time to time to reflect new features, content formats, legal requirements, or business changes. The current version identifier and its effective date are shown on this page.

For non-material changes, your continued use of the Service after the updated Terms take effect constitutes acceptance. For material changes — including changes that affect your rights, obligations, or the permitted use of Output — we will take reasonable steps to notify you and will require you to re-accept the updated Terms before continuing to use the Service. If you do not agree to an update, you must stop using the Service.

These Terms are governed by Laws of India. Courts at Moradabad, Uttar Pradesh shall have exclusive jurisdiction, subject to your statutory rights.
